These Terms of Service (“Terms”) govern access to and use of https://kervaniq.com and its related online store, content, products, features, and services, collectively referred to as the “Services.”

The terms “Kervaniq,” “we,” “us,” and “our” refer to Kervaniq. Our ecommerce store is hosted by Shopify, which provides the platform used to make the Services available.

By accessing or using the Services or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

You must be at least the age of majority in your place of residence or have the permission and supervision required by applicable law to use the Services.

You agree to provide current, accurate, and complete information when creating an account or placing an order.

You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorization.

Where a conflict arises, the policy specifically addressing the relevant matter will apply, subject to mandatory consumer law.

3. Products and Product Information

We make reasonable efforts to describe and display products accurately.

Product colours may vary because of lighting, photography, screen settings, and manufacturing variations. Measurements and sizing information are approximate unless expressly stated otherwise.

Customers should review the complete product description, size information, materials, care instructions, price, and availability before purchasing.

Brand, environmental, origin, certification, performance, health, and safety claims apply only where expressly and accurately stated on the relevant product page.

Nothing in this section limits a customer’s rights where a product is faulty, materially misdescribed, incorrect, or otherwise does not conform to the applicable contract.

4. Prices, Currency, Taxes, and Promotions

Prices are displayed in the currency selected or shown on the website and during checkout.

Prices include applicable taxes where required by law. The final currency, product price, discounts, taxes, delivery charges, and total amount payable will be clearly displayed before the customer submits the order.

Free standard shipping applies to all orders, with no minimum purchase requirement. Duties, import taxes, and destination charges not collected during checkout are addressed in our Shipping Policy.

Prices and promotions may change prospectively without notice. A price change will not affect an order that has already been accepted, except where the customer expressly agrees or applicable law permits otherwise.

Discounts, reference prices, stock statements, countdowns, and limited-availability claims apply only where they are genuine and accurately displayed.

If a material pricing or listing error occurs, we may contact the customer before accepting the order and offer the option to:

• Proceed using the corrected information; or

• Cancel the affected order for a full refund.

We will not charge a corrected price after order submission without the customer’s agreement.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase.

An automated order confirmation acknowledges receipt of the order but does not necessarily mean the order has been accepted. Acceptance occurs when we confirm fulfilment or dispatch, subject to applicable law.

Please review your product selection, quantity, delivery address, billing information, currency, and total amount before submitting an order.

We may decline or cancel an order for legitimate reasons, including:

• Product unavailability;

• Payment failure;

• Suspected fraud or unauthorised payment;

• Delivery restrictions;

• A material pricing or listing error; or

• A material violation of these Terms.

If we cancel an order after payment has been captured, the amount paid for the cancelled product will be refunded to the original payment method.

6. Payment

Customers represent that they are authorised to use their selected payment method.

Payments are processed by Shopify and authorised payment providers. Available methods are displayed during checkout and may vary according to location, currency, device, order value, and provider eligibility.

Kervaniq does not ordinarily receive or store complete payment-card numbers. Customers should not send complete card numbers, card security codes, online-banking passwords, or other sensitive payment credentials by email, telephone, or contact form.

Payment authorization does not guarantee that an order will be accepted. Additional verification may be required to prevent fraud or unauthorised transactions.

7. Shipping and Delivery

Orders are normally processed within 1–3 business days after payment authorization and order confirmation.

After dispatch, standard delivery is estimated to take 7–15 business days. The estimated total time from confirmed order to delivery is therefore 8–18 business days.

Free standard shipping applies to all orders, with no minimum purchase requirement.

Shipping destinations, order processing, tracking, customs charges, delivery delays, lost parcels, and other shipment issues are governed by our Shipping Policy.

Delivery estimates are not guaranteed arrival dates unless Kervaniq has expressly agreed to a particular delivery deadline. Nothing in this section limits any mandatory rights concerning delayed or undelivered goods.

8. Returns, Refunds, and Cancellations

Eligible return requests may be submitted within 30 calendar days after delivery.

Return conditions, procedures, exclusions, return shipping responsibility, inspection, and refund timing are governed by our Return and Refund Policy.

Kervaniq pays approved return shipping costs for verified products that are:

• Damaged;

• Defective;

• Materially misdescribed; or

• Different from the product ordered.

Customers are responsible for return shipping costs for preference-based returns, including change of mind, fit, size, or colour, except where applicable law requires otherwise.

Customers may also have a statutory right to cancel an eligible online purchase. United Kingdom consumers generally have the right to notify us of cancellation within 14 calendar days after delivery and then return the eligible product within a further 14 calendar days.

These statutory rights are explained in our Return and Refund Policy and are not limited by these Terms.

9. Order Changes and Cancellations Before Dispatch

Contact us as soon as possible if you need to change or cancel an order.

We will make reasonable efforts to assist, but cancellation or modification cannot be guaranteed after processing or fulfilment has begun.

If the order has already been dispatched, the customer may need to receive it and follow the applicable procedure in our Return and Refund Policy.

If Kervaniq cancels an order before shipment, any captured payment for the cancelled product will be refunded to the original payment method.

Nothing in this section limits any mandatory cancellation rights.

10. Customer Content and Reviews

If you submit a review, photograph, video, comment, suggestion, or other content, you represent that:

• You own the content or have permission to submit it;

• The content is accurate and lawful;

• It does not infringe another person’s rights;

• It does not contain malicious code or misleading material; and

• Any opinion expressed reflects your genuine experience.

You grant Kervaniq a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use submitted content in connection with operating and promoting the Services.

This licence does not transfer ownership of your content to Kervaniq. Our handling of personal information contained in submitted content remains subject to our Privacy Policy and applicable law.

11. Acceptable Use

You must not use the Services to:

• Violate applicable law;

• Submit false, inaccurate, or misleading information;

• Commit fraud or make unauthorised payments;

• Interfere with website security or operation;

• Introduce malware, viruses, or other harmful code;

• Attempt to gain unauthorised access to the Services or another customer’s account;

• Collect information about other users without lawful authority;

• Abuse, threaten, or harass another person; or

• Copy or commercially exploit protected website content without permission.

We may restrict or terminate access for material violations of these Terms, subject to applicable law.

12. Intellectual Property

The Kervaniq name, website design, logos, text, graphics, photographs, videos, and other content are owned by Kervaniq or used under licence and are protected by applicable intellectual-property laws.

Third-party product names, trademarks, images, and other intellectual property remain the property of their respective owners.

No provision of these Terms grants permission to copy, reproduce, distribute, modify, or commercially exploit protected content except where expressly permitted by Kervaniq, the applicable rights holder, or applicable law.

13. Third-Party Services and Links

The Services may use or link to independent third-party services, including Shopify, payment providers, delivery carriers, and social-media platforms.

Independent third parties operate under their own terms and privacy practices. Kervaniq is not responsible for independent third-party content, availability, or practices outside our reasonable control.

The inclusion of a third-party link does not necessarily constitute an endorsement of that third party.

14. Privacy

Our collection, use, retention, protection, and disclosure of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge that personal information will be handled as described in that Policy and in accordance with applicable law.

15. Warranties and Consumer Rights

To the fullest extent permitted by law, the website and its non-product content are provided on an “as available” basis.

We do not guarantee that the website will always be available, uninterrupted, secure, or free from technical errors.

Nothing in these Terms excludes or limits:

• Statutory warranties or guarantees;

• Product-quality or conformity obligations;

• Rights concerning faulty or misdescribed goods;

• Cancellation or withdrawal rights;

• Repair, replacement, or refund rights; or

• Other consumer protections that cannot lawfully be excluded.

If mandatory consumer law provides more favourable rights, those rights will apply.

16. Limitation of Liability

To the fullest extent permitted by law, Kervaniq is not responsible for indirect or consequential losses that were not reasonably foreseeable when the applicable contract was formed.

Kervaniq is not responsible for losses caused solely by events outside our reasonable control, except where applicable law provides otherwise.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for:

• Fraud or fraudulent misrepresentation;

• Death or personal injury caused by negligence;

• Wilful misconduct; or

• Breach of mandatory consumer rights.

17. Electronic Communications

You agree that order confirmations, receipts, payment notifications, shipping updates, security notices, policy notices, and other transactional communications may be provided electronically using the contact information supplied with your order or account.

You are responsible for ensuring that the email address and telephone number associated with your order or account remain accurate.

Transactional communications may still be sent after you unsubscribe from promotional marketing.

18. Governing Law and Consumer Jurisdiction

These Terms are governed by the laws applicable in England and Wales.

If you are a consumer, this provision does not deprive you of any mandatory protection available under the laws of your place of residence.

Nothing in these Terms prevents a consumer from bringing a claim in a court or jurisdiction available under applicable law.

19. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed.

The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms and the policies incorporated into them constitute the agreement governing use of the Services and purchases made through our store, except where mandatory law provides otherwise.

A failure by Kervaniq to enforce a provision on one occasion does not waive the right to enforce that provision or another provision in the future.

21. Changes to These Terms

We may update these Terms to reflect changes in our operations, Services, technology, or legal obligations.

The current version will be published on this page with an updated “Last updated” date.

Changes will apply prospectively unless applicable law requires otherwise. Material changes affecting an existing order or customer right will not apply retrospectively unless the customer agrees or applicable law permits.
